General

The following terms and conditions form a legally binding agreement between yourself, as the customer, and the servicing company, OpticalNext (OpticalNext.com, OpticalNext Inc.). These terms have no effect on any other rights you may have as per the law.

When you accept the terms and conditions stipulated in this agreement, inclusive of contact and payment information, you are also confirming that any information divulged is accurate and up to date.

Moreover, when you agree to the terms and conditions, you are also confirming that you understand that this contract supersedes any previous written or verbal agreements made relating to the products and services on offer.

Products and Services

The sale of any products or services offered on this website is completely dependent on availability. If a particular item for purchase is not currently in salable stock, you, the customer, will promptly be informed, and no fee will be charged.

Any picture or photographs found on this website are purely for illustrative purposes only and do not necessarily match the actual items on sale.

While we make it a point to ensure that all the goods and services provided by us are identical to those present on the website, we urge you to understand that there may be small variations between the specifications mentioned on the website and the final product that you receive. These variations are subject to the accuracy of information provided to us by the manufacturing parties.

Our company, OpticalNext, will not be held responsible for any typographical inconsistencies or omissions regarding illustrations, text, or prices. Moreover, OpticalNext reserves the right to cancel any order for reasons of our own. In such an event, no fee will be levied to the customer.

Price and Payment

Any and all prices mentioned on this website are not inclusive of taxes and shipping charges that may be applicable. The customer will be informed of the total amount payable once the order has been placed and confirmed.

OpticalNext accepts the following modes of payment – Visa, American Express, Discover, and MasterCard.

All payments made via credit card are subject to confirmation by the issuer of the card. If in any event the authorization is declined, we will be unable to deliver the relevant products and cannot be held responsible for non-delivery.

Prescriptions

Before an order can be placed and confirmed on our website, the customer must provide OpticalNext with prescription details. All prescriptions must be provided by a licensed and registered medical practitioner or ophthalmic optician, following a thorough eye examination that is no older than two years. The prescription details provided by the customer is the same that we will integrate into the lens of the spectacle products purchased.

In the event that you, the customer, are not entirely sure of your prescription details, it is your responsibility to arrange an eye examination with a licensed medical practitioner or ophthalmic optician. We do not provide such services, as this may be in violation of medical ethics and access to patient information policies.

All our customers are required to be over the age of 18, and eligible for prescription spectacles. A customer is not allowed to order spectacles on behalf of any party that is below the age of 18.

Moreover, the customer cannot be registered as partially sighted or blind.

OpticalNext will not be held responsible for any inaccurate information provided by the customer.

Shipping and Delivery

All items that have been purchased will be subsequently delivered to the shipping address provided by the customer on the specific order form, but only after the full payment has been received.

All orders are processed either in a lab in China, or one of our other locations. While we do our best to ensure timely delivery of all purchased items, there is a likelihood of delays as a consequence of poor weather conditions, governmental procedural complications, and other such reasons that we are not in control of. The shipping time specified is only an estimation and does not come with a guarantee. We cannot be held responsible for any inconvenience or loss caused as a result of any delay of delivery.

Furthermore, our company, OpticalNext will not be liable for any products that go missing or become damaged during the process of shipping.

Return of Products

The Returns process requires the customer in question to contact our customer service department, to obtain a Return Product Authorization (RMA), before the product can be sent back. A product that has been returned without an RMA will consequently be shipped back to the customer.

Any and all shipping and handling expenditure will NOT be refunded.

In the event that a customer has made an error while placing the order, or if he/she has changed their mind about an item, it is possible to return the product for a 50% refund to the credit card used, or a full refund in store credit if another product is purchased within the next 30 days.

If a product is being returned, it must include the original packaging and case, along with the cleaning cloth in ‘new’ condition.

OpticalNext reserves the right to assess and determine if the products are damaged or ruined, and consequently deny a customer’s request for a refund or exchange in the event of product damage.

Inspection of Products

Once a product has reached the customer, he/she is advised to fully inspect the relevant product for any damage sustained. If the product(s) is found to be defective, customers are urged to refrain from using them, and immediately contact us.

Every product shipped will also include a confirmation of the details of prescription. If the prescription is different from the one placed in the online order, customers are urged to refrain from using the product, and contact us immediately.

Warranty

The products provided by OpticalNext.com do not come with any explicit or implied warranties. When you place an order on the website, you are agreeing to take on any risk associated with information or distribution of products. OpticalNext is not able to claim responsibility for any inconsistencies or inaccuracies in the information provided on the website, as it relates to the materials used in manufacturing.

Limited Liability

Any information provided on the website is done so with no guarantee of accuracy.

The customer claims any risk from damage, loss from the use of, or the inability to use the online platform or products offered. As much as legally possible, OpticalNext expressly disclaims any warranties regarding the website, services, and products on offer. OpticalNext’s liability to the customer is limited.

By agreeing to this, you understand that OpticalNext has not been in breach of any provision stipulated within this arrangement, as it relates to delay, non-delivery, or quality of products that result as a consequence of governmental policies and procedures, poor weather conditions, war, strikes, lockouts, server intrusion, computer viruses, hacker attacks, connectivity failures, natural disasters, or any such condition that is not within our control.

The total amount of liability we claim, inclusive of our employees, subcontractors, and third party agents, whether in breach of statutory duty, contract, tort/negligence, or otherwise, will never exceed that of the prices of the products and services as they relate to the claims made.

The company, its employees, third party agents, and subcontractors will not be held responsible for any kind of business interruption, loss of data, loss of profits, loss of use, contracts, goodwill, or anticipated savings, under any circumstance.

Transfer of Contract

The following contract relates to you, the customer, and only you. It is completely non-transferable.

We reserve the right to transfer, re-assign, or sub-contract a part of or the full agreement to any third party agency.

Changes to These Terms

OpticalNext reserves the right to make amendments and modifications to the terms and conditions stipulated in this agreement at its own discretion. If this is the case, the new version and date of effect will be posted on the website. A customer who continues to use the website, following the date of effect, will be understood to be in acceptance and compliance of the revised terms and conditions.

Copyright

The designs and logos present on the website are the exclusive property of OpticalNext. OpticalNext owns all rights pertaining to the title present in its Logos, inclusive, but not limited to, trademark copyright, trade dress, moral rights, service mark, rights under any statutory protection of fine arts, and otherwise, if applicable.

Any content found on the OpticalNext website, including diagrams, illustrations, statements, button icons, signs, audio document segments, downloadable content, data edits, and software is the exclusive property of our company.

Your Account

If you are using our website, you are responsible for managing your own account and keeping your user information and passwords safe. You will be understood to be in approval of any activities undertaken with the use of your user information and password.
